General provisions
This document is a public offer (an offer addressed to the public at large) by Individual Entrepreneur Nikita Trushkin (the “Company”, “we”), registered at 3500, Georgia, Ozurgeti Municipality, Gogieti village, 3rd Street, building 11, personal tax number 145888019. The Offer governs the terms of use of the website lup.ge (the “Site”) and is not a public offer to enter into a construction contract: commercial terms of renovation are agreed individually and formalised in a separate written contract. Use of the Site in any form (browsing pages, submitting enquiries, using the calculator, downloading materials) constitutes unconditional acceptance of this Offer. If you do not agree with its terms, please discontinue use of the Site.
Definitions
“Site” means the software and hardware complex available at lup.ge, including all subdomains, pages and services. “User” means any individual or legal entity using the Site. “Content” means texts, graphics, audio-visual materials, source code, branding and other protected works hosted on the Site. “Enquiry” means a request submitted via Site forms, messengers or email seeking information, an estimate or a commercial proposal. “Calculator” means an interactive tool for preliminary cost estimation. “Agreement” means this public offer.
Subject of the offer and scope of services
The Site provides the User with access to the following information services: 1) descriptions of renovation and finishing services, portfolio, reviews, blog articles; 2) an online calculator for preliminary cost estimation; 3) forms for submitting enquiries for a free measurement, estimate or callback; 4) downloads of template documents (contract, acceptance certificate, policies); 5) contact information. All Site services are provided free of charge. Information on the Site is informational in nature: exact commercial terms of a renovation are determined individually after an on-site engineer visit and formalised in an estimate and construction contract. Calculator results and any published indicative prices do not constitute a public offer to enter into a construction contract within the meaning of Article 329 of the Civil Code of Georgia.
User rights and obligations
The User undertakes to: 1) use the Site only for lawful purposes and in accordance with this Agreement; 2) provide accurate information when submitting enquiries; 3) not attempt unauthorised access to the Site, its databases or servers; 4) not post via forms or comments any offensive, unlawful or defamatory materials, or third-party advertising; 5) not use automated mass-collection tools (parsing, scraping) without the Company’s written consent. The User is entitled to: receive information about the Company’s services; submit enquiries and receive a response within a reasonable time; discontinue use of the Site at any time; withdraw consent to the processing of personal data as set out in the Privacy Policy.
Company rights and obligations
The Company undertakes to: maintain the Site in accordance with reasonable technical standards; process incoming enquiries and respond within a reasonable time (as a rule, within one business day); protect Users’ personal data in accordance with the Privacy Policy and applicable law. The Company is entitled to: change the structure, design and scope of services of the Site at any time without prior notice; temporarily restrict access to the Site for maintenance or for reasons beyond its control; refuse service to a User in case of breach of this Agreement, attempted fraud or improper conduct; respond to enquiries via messengers, email or telephone using the contacts provided.
Enquiries, estimates and pre-contractual relations
Submission of an enquiry by the User via the Site, a messenger or email is an indication of intent and does not create any obligation on either party to enter into a construction contract. Following processing of the enquiry, the Company may send the User a preliminary commercial proposal which is also not a public offer and is subject to refinement following an on-site engineer visit. A construction contract is concluded only upon signing of the relevant document by the parties in writing (including by exchange of signed PDF copies). The terms of the construction contract — subject, price, timeline, warranty — are recorded in a separate contract and its annexes and are not governed by this Offer.
Intellectual property
All materials hosted on the Site, including design, photographs of completed projects, articles, video materials, graphics, the Level Up logo, brand name and databases, are objects of intellectual property protected by Georgian law and international treaties. Exclusive rights belong to the Company or are used under licence. The User is granted a limited, non-exclusive right to use the Site for personal non-commercial purposes. Without the Company’s written consent, it is prohibited to: copy the Site or its substantial parts; use Content for commercial purposes; modify, decompile or reverse-engineer software components; use branding or project photographs on third-party resources. Quotation of texts with a mandatory active hyperlink to the source is permitted to the extent justified by the purpose of the quotation.
Limitation of liability
The Site and Content are provided “as is”. The Company makes reasonable efforts to keep information up to date but does not guarantee: 1) uninterrupted and error-free operation of the Site; 2) absolute accuracy of published prices, timelines and material specifications — final parameters are fixed only in a signed contract; 3) compatibility of the Site with all devices and browsers; 4) security of data transmitted over the Internet. The Company is not liable for any direct or indirect losses, lost profit or other damage arising from use of or inability to use the Site, nor for the content and operation of third-party resources linked from the Site. Any decisions made by the User on the basis of information from the Site (choice of materials, budget, contractor) are the User’s own decisions.
Personal data and cookies
Processing of personal data submitted by the User via Site forms, messengers and email is carried out in accordance with the Privacy Policy at /privacy and the Georgian Law on Personal Data Protection of 14 June 2023. Use of cookies and similar technologies is governed by the Cookie Policy at /cookies. These policies form an integral part of this Offer. By using the Site, the User confirms having read these documents and accepts their terms.
Amendments, governing law and contacts
The Company may unilaterally amend this Offer. The current version is always available at /oferta with the date of the latest update; continued use of the Site following publication of a new version constitutes acceptance thereof. If the User does not agree with the changes, the User must discontinue use of the Site. This Offer is governed by and shall be construed in accordance with the laws of Georgia. All disputes arising in connection with the use of the Site shall be resolved by negotiation; failing agreement, in the competent court at the Company’s location.
